Our Interpretation. Your Acceptance.
This notice outlines how Ncpays approaches the General Data Protection Regulation (GDPR) for users within the European Economic Area (EEA) and the UK. Please understand that while we acknowledge GDPR, our primary operational focus dictates our data handling practices. By using Ncpays, you acknowledge and accept our interpretation and application of these regulations.
1. Data Controller: We Are It.
Ncpays acts as the Data Controller for the personal data you provide directly to us for the purpose of participating in surveys and utilizing our platform. However, once your data is shared with third-party survey publishers, they may become independent Data Controllers for the data they receive.
ABSOLUTELY NO RESPONSIBILITY: Ncpays bears NO RESPONSIBILITY for the data processing activities, compliance, or liabilities of these third-party Data Controllers. Your engagement with their surveys means you accept their terms.
2. Legal Basis for Processing: What Allows Us to Act.
We process your personal data based on several legal grounds:
- Consent: By creating an account and participating, you provide explicit consent for us to process your data, including sharing with third parties. Your consent is a prerequisite.
- Contractual Necessity: To fulfill the services you request (e.g., matching you with surveys, processing payments).
- Legitimate Interests: For platform improvement, fraud prevention, security, and analytics. Our interests typically override yours in these matters.
3. Your GDPR Rights: Subject to Our Discretion.
While GDPR outlines certain data subject rights, Ncpays will assess and process such requests at its sole discretion, considering our operational constraints, legal obligations (often non-GDPR related), and technical feasibility. We reserve the right to deny requests we deem unreasonable or detrimental to our business.
- Right to Access: You may request access to your data. We reserve the right to charge a fee or deny repetitive/excessive requests.
- Right to Rectification: You may correct inaccurate data. We will consider valid requests, but some data, especially in survey responses shared with third parties, cannot be altered.
- Right to Erasure ("Right to Be Forgotten"): You may request deletion of your data. This right is highly restricted; we will retain data necessary for our legitimate business interests, fraud prevention, legal compliance, and data already shared with third parties (for which we are not responsible).
- Right to Restriction of Processing: We will consider requests to limit processing, but it may impact your ability to use the platform.
- Right to Data Portability: We are under no obligation to provide your data in a specific format beyond standard exports we may offer at our discretion.
- Right to Object: You may object to certain processing. If your objection hinders our operations, your account may be terminated.
- Right Not to Be Subject to Automated Decision-Making: Our AI extensively uses automated processing for matching. You cannot opt-out of this if you wish to use the platform.
- Withdraw Consent: You may withdraw your consent at any time. However, this does not affect the lawfulness of processing based on consent before its withdrawal, NOR does it affect data already shared with third parties. Your data shared with third parties remains subject to their policies. Withdrawal of consent will likely lead to account termination.
4. International Data Transfers: Beyond Your Control.
Your personal data will be transferred to, and processed in, countries outside of the EEA/UK, including the United States, where data protection laws may differ. By using Ncpays, you explicitly consent to such transfers.
FINAL WORD: Ncpays makes no assurances regarding the adequacy of data protection laws in third countries, nor do we accept any liability for data once transferred to and processed by our third-party partners globally.
5. Right to Lodge a Complaint: Your Last Resort.
While you theoretically have the right to lodge a complaint with a supervisory authority, we urge you to address any concerns directly with Ncpays first. We reserve the right to address or dismiss your complaint at our sole discretion.
6. Policy Amendments: We Set the Rules.
Ncpays reserves the absolute and unilateral right to modify, amend, or update this GDPR Notice at any time, without prior notice or your consent. It is your responsibility to review this policy periodically. Your continued use constitutes acceptance of any and all changes.
